Claims brought pursuant to Labor Law § 200 require a thorough knowledge of the relevant case law and safety regulations. In handling such claims, a careful and comprehensive approach to evaluating the entire matter, including identifying and pursuing indemnification, coverage and other contractual issues, is of paramount importance. Our sophisticated analysis of the relevant construction contracts, as well as various insurance policies, frequently afford additional insurance protection for our clients. Whenever possible, we aggressively pursue a transference of the "absolute" liability that is imposed under Labor Law 240 by tenders to other entities or insurance carriers and, where appropriate, declaratory judgment actions to compel indemnification from other sources.
